    Morgan and Morgan are notorious ambulance chasers. If this poor woman was a victim of unsafe practices from Disney, then she deserves the win. I’m just skeptical of her claims given who she chose to represent her.

      Unfortunately she did not choose her representation. If you read the article you’ll see she passed away. This is what the lawsuit is all about.

      Her cousin and family are the ones with the lawsuit.

    It is so sad for the family. But Disney never takes blame. I worked for them, and tripped on a mat, My ankle swelled up so fast, they sent me to Health service, then right back to work, standing on 1 leg. Their doctor made an ankle brace for me after the mri showed an infusion in the bone. Made me work every day in pain, no compensation. Bad company to work for.

      I have heard that fusion in bone is (or could be) osteoporosis not related to the injury.

      You should get yourself checked out or you could have other problem areas now and in the future.

      I’m all for a company paying if the accident is a result of something they either failed to do properly or didn’t do at all and should have…but, to pay simply because someone tripped and fell due to their own clumsiness, or carelessness, etc., then no. If there is just cause for this lady’s accident and subsequent death, then it should be spelled out and made very clear. To not do that leads one to believe that the cousin is just after easy money. And that type of suing is what sends insurance rates through the roof.

        Welcome to the world of liability. That’s why you have homeowners insurance, for example. Someone could trip on your sidewalk and sue you for injury even if you kept your sidewalk perfectly clean and there were no uneven gaps in the pavement. It works the same for someone on a company’s property. Should torts law be different in the U.S.? Yes.

        This article asks us to make conclusions without providing us with any useful facts. So, the answer is, if this woman died as a result of injuries sustained while at a Disney park, her estate will be entitled to receive damages. If it cannot be proven by a preponderance of evidence that she sustained injury on Disney property, Disney will prevail.

    How, when, and where exactly did she fall and what injuries did she sustain? Who did she report it to? These questions were not given in the article, and it is implied they have not been addressed in the court filing. I would need a lot more of the details to understand the case. It seems this case will be as clear as mud!

      Actually the article states that this is the reason for request of dismissal. The lawsuit lacks any information that shows liability on Disney. Paraphrasing, The lawsuit does not show location on the 200plus acre property, does not show sustained injury leading to the death of the victim and a lot of other details that would be required to prove that Disney is responsible for the injury.

    Don’t ask why prices are so high when there is always someone trying to get money. Sad that she died but what did Disney do that was negligent? Morgan and Morgan has a personal vendetta against Disney.

    If you have an injury particularly a fall, have a.Disney staff member write up a report & get a copy even if you don’t think much of it at the time. You may not need it but if you do you’ll have it. Goes for any theme park or public venue.

    The reference to a thorough reading of the 6-page complain is hilarious! Cheeky reaponse by Disney counsel (the complain should be much longer for this type of case)

    Just because she fell and subsequently died doesn’t make it Disney’s fault. Maybe she was wearing unsafe shoes. Maybe she had a medical issue that caused the fall. There are too many “maybes” to say it’s Disney’s fault.

    Ridiculous, these people fall and they want to sue somebody. I see them all the time down there walking around unstable. It’s a shame and I feel bad for the poor woman but sounds like someone’s trying to get rich after the fact.
