No, having a phone in the park isn’t the problem. It’s the people who have them out while on rides that are the problem. Personally, I would have refused to give the guy his phone back until he paid the medical bills. And the cops were wrong (THERE’S a surprise); the child was the victim of assault and battery. Had the clown thrown the phone at her, he would have been charged. This is no different.

No reason to have a phone out on a ride like this. Hopefully the settlement will spur parks to start banning people who pull this.
