Guest Files $50 Million Lawsuit Over Bathroom Incident at Universal Orlando

A man has filed a lawsuit against Universal Orlando Resort after allegedly falling in a slippery bathroom at the Central Florida vacation destination’s water park, Universal Volcano Bay. The filing claims that the man suffered a brain bleed as a result of the incident.

According to the Orange County Clerk Court Records (OCCCR) website, Searcy Law initiated the lawsuit on behalf of the plaintiff, Joshua De La Cruz, on September 24, 2025. De La Cruz claims that after riding the Ko’okiri Body Plunge waterslide on July 11, 2025, he asked a nearby “lifeguard” where to find the nearest restroom.

Upon walking into the bathroom, De La Cruz says he slipped and fell due to “excessive water” on the floor. The Universal Park guest reportedly hit his head, “was knocked unconscious, and woke up in a pool of his blood.” He was taken by ambulance to a nearby emergency room and diagnosed with a “significant brain bleed.”

The lawsuit argues that “a reasonably prudent venue would not have [a] bathroom floor that could pose a danger to its invitees.” It accuses Universal Orlando Resort of several instances of negligence in the Universal Volcano Bay bathroom, including failing to provide a safe bathroom floor, failing to dry the surface, and failing to post signage warning guests about the wet floor. It also claims that other substances like sand, sunscreen, and other oils may have contributed to the slippery conditions.

The complaint demands $50,000,000 from Universal Orlando Resort, arguing that Joshua De La Cruz “suffered bodily injury with resulting pain and suffering, disability, disfigurement, mental anguish, inconvenience, loss of capacity for the enjoyment of life, expense of hospitalization, medical and nursing care and treatment in the past and in the future, loss of earnings, loss of ability to earn money, and aggravation of a previously existing condition.”

“The losses are either permanent or continuing and plaintiff will suffer the losses in the future,” it concludes.

Universal Orlando Resort hasn’t commented publicly on this lawsuit related to Universal Volcano Bay. The Central Florida theme park recently settled another case from a woman who claimed she was injured on Stardust Racers. This complaint followed increased public scrutiny about the Universal Epic Universe attraction after a disabled man died on board due to “multiple blunt impact injuries.” The guest’s death was ruled an accident, but his family has hired a lawyer, and the investigation is ongoing.
