      Totally agree. You know it’s a wave pool. Be aware of the risks involved. People just out for money. Hope the money grubbing lawyers get nothing and the case dropped. Ridiculous

        I hope they have lots of pictures. There is NO way she could be thrown across to the other sides of the pool. My 90 yr old mom loves the wave pool. She has never fallen because she pays attention to the waves and her surroundings..

    If this guest was truly injured as stated, then Disney should pay: medical bills (of course) and some compensation for pain, disruption of their vacation, etc. But not $2,000,000! Max $5,000 and I consider that generous … and assuming her injuries were as claimed.

    I’m sorry, but the whole problem today is everything is always someone else’s fault, never our own bad decision; I have been in this pool several times and it’s easy to tell before you enter that the tide is STRONG. Unfortunately, the way our courts now work, this party will receive a settlement not because they deserve one, but because Disney has money, all large companies now have to deal with nuisance lawsuits. Of course, companies cannot absorb these costs and stay in business, and in the end, we all pay.

    1. If the judges would start throwing these ridiculous lawsuits out, maybe less people would stop wasting the courts time. Wave is a wave. The suit is in Brooklin, so she should know about waves. All of Long Island has beaches and the New Jersey shore is a favorite vacation spot for New York people.

        Absolutely!! If the cases were thrown out as frivolous and they were fined for the cost of both parties attorneys, these idiotic suits would stop.

    I don’t read anywhere that she received medical treatment. If the injury is as bad as they claim, she should have been taken to the emergency room or, at the very least, been treated by Disney’s own medical people.

      I agree.. did they seek medical care? Did they tell a cast member? If not then disney had no notice of the accident. The $250 they offered her was the price of the tickets for the water park.

        Just a money grab! I agree with everyone else…if there were such “severe” injuries she should have been transported to the hospital. And as for hubby, he should have realized his wife needed a bicycle helmet and knee and elbow pads because of her mental state! 🤣

    I guess I missed my chance to get rich quick. People are crazy. Never would I have thought to do something like this.
    When I was a younger teen, I was in the wave pool and was thrown into another kids head and got a light concussion and a goose egg bump on side of my head. Disney’s medical checked me out, gave me a free bottle of water, and a bag of ice, and was told to not do anything jarring rest of day and have someone keep an eye on me, and informed me of possible symptoms, and if I got worse to get seen asap. Spent the rest of the day in the lazy river and got a sun burn on my back. Ruined that day at the water park for me and trying to sleep that night.

      This is ridiculous. $2 million? I saw a picture of her leg on another newsletter. Some scrapes on the lower part and ankle, yes, but nothing like they portray, smh. Absurd.

      My wife and I flipped over on a float on one of the water slides in the park. We were about half way down and kept going higher and higher in each turn. Finally, we actually flipped. She broke her wrist as she hit the slide. She and the tube disappeared and I had to walk the rest of the way to the end of the slide and jump into the pool at the end. As I was walking down, I heard some laughing and screaming and realized that I had forgotten about the other tubes behind us!!! When I heard them coming, I would move the the inside of the nearest curve and pull myself up as tight as I could to get out of the way!! Ha! Ha! I did that three or four times before I got to the bottom! They were very nice and checked my wife in the park and suggested that we take her to the Celebration Hospital to be checked. They gave our family five free passes to use in the future although we had already been at the water park for five hours. The Doctor at Celebration Hospital determined it was a fracture and gave her a support brace for the rest of our trip. We never paid anything and received a letter in the mail a few weeks later apologizing for the incident and that Disney had taken care of all medical bills. We were happy with that and did not feel it was their fault.

    What kind of “lasting impact the incident has had on Kimberly’s quality of life.” could this have had? Why did she have to stay inside when they planned on a pool day? She could have laid out by the pool. People are too sue happy and Disney will settle out of court for an undisclosed amount. You should know when you get in a wave pool that there will be waves and how do you get dragged 15-20 ft? Ridiculous

      Losers… GET A JOB and MAKE YOUR OWN MONEY instead of looking for a free ride. Save your dollars and go to a local theme park. Don’t go back to Disney… it’s toooo dangerous! This crap that goes on just makes me so angry. JUST STOP!

  9. I would never bring my 3 year old Grandson to the wave pool even if there is a “child” section. Also the siren/horn goes off before the wave starts . Would be interesting to see via the security cameras just how close she was to her child.

    My father was a on staff lawyer for Disney for 20+ years. They receive multiple law suits a week literally. If the plaintiffs Truly have a case Disney will settle but not for 2 mil also if they are dvc members or passholders or even Disney+ subscriber’s in the fine print you agree to arbitrary actions hince can’t sue Disney.

      I totally agree! I have stepped off curbs of all types of business, including Disney Parks and gotten “road rash” but I own that it was my fault! She should have gone to the park’s medical center, gotten some ice, a tissue, and get over it. She also needs to STOP whining and embarrassing herself and family!

    Don’t understand why this incident “ruined their anticipated vacation and plans”. Many others would have bandaged up, gone to a Park and possibly rented a scooter for the day! Yes, road rash is painful..I messed my ankle and shin up when I was a child and I am still here with no scars or mental pain except for being a bit embarrassed when I think about that event.

      I got knocked down at animal kingdom, scratched up my knee bad enough to have two scars AND ended up having to have achilles surgery… all I asked for was a BANDAGE !!! I went on and ENJOYED the rest of my day!

    Why wasn’t she with her 3 year old instead of having to “rescue” them from a slide? And why is no medical attention mentioned?Disney is the best at helping injured guests. Not paying attention to her child and the pool is what injured her. I hope she gets nothing. You can’t fix stupid.

    Sue sue sue is the answer to everyone’s get rich scheme. Her lawyers is probably the ones telling her to go for this much so they can get the bulk of the money as well they are the ones enticing their clients. Lets go for this much and see what Disney settles for RIDICULOUS!

    Are you serious!!!! If the waves were little she’d probably sue because it didn’t meet her expectations…. What is wrong with people? ITS A FLIPPING WAVE🌊 POOL!!!! Easy money? She should be ashamed of herself AND the greedy ass attorney also. I hope this goes to court and the judge/jury laugh her out of the courtroom!!!!!!

    I have no way of knowing for sure, but I would assume that each and every wave generated at Typhoon Lagoon is equal in strength. I’m sure this lady was quite aware of the waves’ intensity and knew exactly what was coming towards her. Like others said, it’s just a money grab attempt.

    The couple comes from Long Island which is surrounded by water that includes an ocean..an ocean that constantly has waves…would they sue the beach if she got knocked over by a wave? They are just money hungry people who found an ambulance chasing lawyer and an easy target.

    I was sitting at the back of the wave pool with my mother who was about 92 at the time. The waves are quite strong as they hit the back, but it was fun and she was having fun. I was holding onto Mum to keep her safe and my elbow took a hefty blow as I had it wrapped around her. Very painful, took several months to heal. Not the pool’s fault or Disney’s. Sat somewhere else the next time. Water is powerful. Not everything can be controlled

    What a bunch of idiots every Disney park, cruise, hotel/resort or location has medical staff/personnel how about you greedy morons speak with them or see them instead of freaking suing the water park, plus it’s the lady’s and the family’s own fault for not keeping an close eye on their kid.     My hubby and I got road rash from typhoon lagune. It didn’t stop us from going and finishing up our vacation. Money hungry people.

    well she better not go to any ocean. the waves there are usually bigger than typhoon lagoon. i hope the judge throws it out. he needs to tell her. it does say wave pool lady, not ripple pool
