The case in England, I believe, was determined by one judge; The case in Virginia was determined by a jury of the parties’ peers, not sure whether 6 or 12, but definitely more than 1.

And as far as the UK trial, American law is more stringent in libel cases. The bar is much higher. In the US a plaintiff in a libel trial has to prove that they were harmed by an entity acting with actual malice, meaning they knew a libelous statement was untrue when they made it.

However then he testifies for those occasions he is calm and fairly sober and she is the ‘nagging hysterical shew.’ Ya right. This is just one reason why Nicols did not find Depp’s testimony credible. The Appendix of Evidence and all his conclusions and his rationales for them provide more reasons.

Depp sued her in the US first, it was postponed due to Covid. And as far as the UK trial, American law is more stringent in libel cases. The bar is much higher. In the US a plaintiff in a libel trial has to prove that they were harmed by an entity acting with actual malice, meaning they knew a libelous statement was untrue when they made it.

Also, the UK was over seen by one person, the judge. The judge decided what her wanted to hear about and what he didn’t.
