At most they should be able to make sales tax applicable to streaming services, but even that could be considered double taxation and potentially not allowed since the consumer already pays taxes on the Internet.
The important thing, that the story glosses over, is that there is a Federal preemption. Federal Law allows the localities to charge up to 5% franchise fees for cable television service. This is specifically to compensate the municipalities for the use of the public Right of Way for the cables. That would be in the ISP, not the content providers. Additionally, in 1998 Federal law was passed that prohibited the taxing by localities for internet content services. So far courts have sided with Disney in regards to the “franchise fee” debate.
I agree but disagree. Disney does bring revenue to those cities and towns, through the sales tax and other taxes are charged for the sale of their services through the provider. Individuals or companies collecting and paying sales tax to counties and states, should not be charged further fees, while already collecting and giving them that Sales Tax revenue.
I do agree that big business should pay their bills but I’m not so sure this fee should be allowed.
In North Carolina I have to pay a fee, for a Privilege license, as a photographer. There is no test or qualification to be one, they are just saying it is a privilege for me to be doing business in their state. I believe it is their privilege that I am here doing business and collecting their taxes. I think it is a privilege to Texas to be collecting taxes on the revenues that this service brings in through sales tax.
Everyone who’s doing business in a particular state or locality is subject to taxes within that area. Whether you like it or not, taxes pay for all the services given. One way or another, the operating expenses are going to be collected from someone. I for one, am sick of paying for everything for everyone else. The amount charged for streaming services is outrageous already, why not just take a few pennies from each bill and pay it? Disney already made money on the movies they’re showing, just how much more money do they need? If they didn’t buy the Marvel franchise licenses, we wouldn’t even pay for the service. Unfortunately, my Beloved loves Marvel. He’s worth making happy, Disney isn’t….
